Section C – Description
The 41’ Utility Boats are reaching the end of their service life and will be replaced by a Response Boat – Medium (RB-M). The RB-M will be a multi-purpose boat that can perform Search and Rescue (SAR), Marine Environmental Protection (MEP), Enforcement of Laws and Treaties (ELT), Recreational Boating Safety (RBS), Ports and Waterways Coastal Security (PWCS), Defense Operations (DO) and other missions. Approximately 180 RB-Ms are required.
The objective of this acquisition is to design, build, outfit, and deliver the RB-M System, consisting of a fleet of approximately 180 RB-Ms, associated support data, equipment, and supplies, for use by the United States Coast Guard, in accordance with all contract requirements.
C.3.1. [Orig] This is the second procurement of a two-phased acquisition. In the first procurement, the Coast Guard awarded three contracts for the construction and support of a RB-M Test Boat. These contracts were awarded on May 2nd 2003 to Ocean Technical Services, Contract No. DTCG23-03-C-ARB065 (OTECH); Manitowoc Marine Group/Marinette, Contract No. DTCG23-03-C-ARB066 (MMC); and Textron Systems, Marine and Land Operations, Contract No. DTCG23-03-C-ARB067 (Textron). This procurement consists of a single contract for the production of the RB-M fleet. Competition for this contract will be limited to those contractors who were successful in the Test Boat contract, in accordance with an approved Justification for Other Than Full and Open Competition signed by the Department of Homeland Security on 13 May 2004.
C.3.2. [Orig] The contract is structured in two periods.
C.3.2.1. [Orig] The Base Contract Period (as described in Section B.1.1) is an Indefinite Delivery Indefinite Quantity (IDIQ) ordering contract extending sixty months from date of award consisting of five 12-month pricing periods. It includes a minimum order of six RB-M and associated supplies and services, including the development of the RB-M detailed design (CLIN 1002). Initial orders will be for Low Rate Initial Production (LRIP) while the Coast Guard conducts Operational Test and Evaluation (OT&E). Following successful OT&E, orders for full rate production may be placed in accordance with the limits set in Section I.
C.3.2.2. [Orig] Option Period 1 (as described in Section B.1.2) is an IDIQ ordering contract extending from the end of the Base Contract Period thirty-six months, in three 12-month pricing periods, to continue full rate production, as necessary.
C.3.3. [Orig] The Coast Guard estimates that it will order a fleet of 180 RB-Ms. Additional RB-Ms may be purchased for Other Government Agencies (OGAs) and Foreign Military Sales (FMS).
The Contractor shall provide project management in support of the requirements found in this contract, including providing the PRO Facilities described in section 087-1 of the Attachment 1 to Section J, the Statement of Work, and all time-based recurring data requirements found in Attachment 3 to Section J, the Contract Data Requirements List (CDRLs). This CLIN is required whenever work under 1002, x003,x004, x005, x006, x007, or x008 is ongoing.
The Contractor shall complete a detailed design of the Response Boat – Medium described in Attachment 2 to Section J, the Specification. The detailed design shall include developing and populating the Integrated Systems Model (ISM) described in section 041-5 of the Statement of Work, developing a configuration management system and the configuration baselines described in section 068-2 of the Statement of Work, developing mock-ups required by section 098-2 of the Statement of Work, conducting any additional testing required under section 092 and 097 of the Statement of Work, developing and providing the initial material required by section 099 of the Statement of Work, and developing and submitting all related data requirements found in the CDRLs. The scope of this item may include additional efforts associated with establishing project management and contract administration requirements found elsewhere in the solicitation. This CLIN must be ordered before orders for CLINs x003 (where x equals a price period) may be placed.
The Contractor shall perform work effort in accordance with Contract Changes incorporated and specified by the Contracting Officer
The Contractor shall construct the Response Boat – Medium in accordance with section 070 of the Statement of Work, provide the Outfit described in section 6 of the Specification, provide all associated data deliverables required by the CDRLs, warrant the RB-M in accordance with FAR 52.246-19 incorporated at Section I.4, conduct tests and trials as described in section 092 of the Statement of Work, and prepare, transport, and deliver the RB-M in accordance with the section 084 of the Statement of Work, the instructions in the delivery order, and Sections E and F of the contract. The scope of this item may include those increased efforts in project management and contract administration associated with having multiple numbers of RB-M under production at the same time, if not allocated to CLIN x001, where x equals the price period.
C.6.1. [A00024] RESPONSE BOAT – MEDIUM POST AWARD CHANGES (CLIN x003yc) (where x equals a price period) (where y equals the associated hull SubCLIN)
The Contractor shall modify the Response Boat – Medium in accordance with incorporated ECPs and REAs .
The Contractor shall design and construct a cradle appropriate to lift, transport, and store the RB-M, in accordance with section 084 of the Specification, and prepare, transport and deliver the cradle in accordance with the instructions in the delivery order and Sections E and F of the contract.
The Contractor shall provide a RB-M model appropriate for public display, in accordance with section 098-1 of the Statement of Work, and prepare, transport and deliver the model in accordance with the instructions in the delivery order and Sections E and F of the contract.
The Contractor shall provide technical advice and support, in accordance with sections 080 and 099 of the Statement of Work
C.10.1.

C.10.3.

The Contractor shall order, process, package, and provide spare and repair parts for the RB-M system, in accordance with the requirements of section 080-2.4 of the Statement of Work.
This section is
reserved for the asset tracking capability described in section 444 of the
Specification. If required, Asset
Tracking for the RB-M is within the scope of this contract but will be the
subject of a contract change to definitize the requirements.
C.13.1. [Orig] The contractor agrees in good faith to negotiate a potential production data licensing package under the following terms if Coast Guard in its sole discretion seeks to obtain a Production Data Licensing Package (PDLP). The Contractor shall provide a PDLP which details all necessary data and grants all necessary rights and licenses for the Government to construct at the Coast Guard Yard the Response Boat – Medium (RB-M) System. The PDLP shall accurately reflect the configuration of the RB-M.
C.13.2. [Orig] Licensing
C.13.2.1. [Orig] For the purpose of construction of the RB-M by United States Coast Guard (USCG) personnel at the Coast Guard Yard, the Contractor shall grant the USCG an irrevocable, non-exclusive, non-transferable, and paid-up license to use, disclose, and reproduce all or any portion of the Production Data for a period of five years from the date of exercise, unless otherwise renewed or extended. At the expiration of license, all rights revert to the remaining requirements of this contract, outlined in Section I.1 and elsewhere.
C.13.2.2. [Orig] Pursuant to FAR 27.404(a), the Contractor shall provide the Government with unlimited data rights to the following: any form, fit, and function data delivered under the contract. Form, fit, and function data means technical data that describes the required overall physical, functional, and performance characteristics (along with the qualification requirements if applicable) of an item, component, or process to the extent necessary to permit identification of physically and functionally interchangeable items; and data that constitutes manuals or instructional and training material for the installation, operation, or routine maintenance and repair of the RB-M and variants to include its systems, subsystems, components, assemblies, subassemblies, and spares and replacement parts. Routine repairs and maintenance under this section is defined as repair or replacement of minor systems and appendages or planned repair of major systems and appendages.
C.13.2.3. [Orig] Pursuant to FAR 27.404(d), the Contractor shall provide the Government with limited data rights required for use by support service contractors for other than routine repair and maintenance work; for soliciting offers for contracts or job orders to repair, maintain, or operate any part of the RB-M; and for emergency repair and overhaul work. An emergency repair or overhaul is defined as repairs that are deemed imminently important to return the RB-M to an operational status. If the Government provides Contractor data to a third party under this section, the Government will make any data disclosure subject to prohibition against further use and disclosure by the third party recipient.
C.13.3. [Orig] Production Technical Data Package (PTDP).
C.13.3.1. [Orig] The Contractor shall prepare and provide a Production Technical Data Package consisting of all of the technical information necessary to construct, produce, repair, and provide logistical support for the RB-M and all of its Manufactured and subcontractor furnished components. The Production TDP shall comply fully with MIL-DTL-31000C, Technical Data Packages, dated 9 July 2004. In addition, the Production TDP shall consist of the following types, elements, and data management products and be delivered in accordance with CDRL 085-008, Production Technical Data Package (PTDP):
